New-build or second-hand: which should I buy in Israel?
The same budget buys a new 4-room apartment delivered in two years or a 1990s 4-room available now. Both have a case. The right answer depends on your horizon, your need for rent and your tolerance for indexation. Here are the criteria, line by line, and a three-year calculation.
The short answer
As of November 2026, a new home in Israel costs 10 to 20% more per m² than a comparable resale in the same neighbourhood, with 18% VAT included in the price. It is paid on a schedule (often 20% at signing, 80% at delivery), with the balance linked to the construction cost index, and delivered in 1 to 5 years, usual delays of 6 to 12 months. In return: a mamad (safe room), no agent fee, legal fees capped at about ₪5,500 + VAT, and a bank guarantee on every instalment. A resale can be negotiated by 3 to 8%, rented or lived in at once, but costs 2% + VAT in agent fees plus works. Purchase tax is identical in both cases. Over three years, ₪2.4M of new build comes to about ₪435,000 more than ₪2.1M of resale, rent included.
The figures to remember, November 2026
- New-build premium per m²
- +10 to 20%
- VAT included in a new-build price
- 18%
- Off-plan delivery time
- 1–5 years
- Agent fee on a resale
- 2% + VAT
The comparison, line by line
| Criterion | New build (kablan, off-plan) | Resale (yad shniya) |
|---|---|---|
| Price per m² | +10 to 20% in the same neighbourhood | Benchmark; discount for condition and walk-up floors |
| VAT | 18%, included in the list price | None between private parties |
| Indexation | Balance linked to the madad tshumot habniya until delivery | Price fixed at contract |
| Time to keys | 1 to 5 years; usual delays 6-12 months, penalties from 60 days | 2 to 6 months |
| Mamad (safe room) | Mandatory | Absent before 1992, communal shelter sometimes |
| Maintenance and works | 1-year bedek warranty, structural warranties 3 to 7 years | Budget 1 to 3% of the price; kitchen and bathrooms often to redo |
| Arnona (municipal tax) | Same rate per m²; new neighbourhoods often in a higher rate zone | Same rate |
| Mas rechisha (purchase tax) | Same schedule, on the VAT-inclusive price | Same schedule |
| Agent fee | None when buying directly from the developer | 2% + VAT, negotiable to 1-1.5% |
| Legal fees | Capped ≈ ₪5,500 + VAT for the developer’s contract (your own lawyer on top, advisable) | 0.5 to 1% + VAT |
| Negotiation | Little on price, a lot on finishes, schedule, indexation | 3 to 8% on price |
| Immediate rent | No, from delivery onwards | Yes, from key handover |
| Financing | Mortgage released in tranches; a 20/80 schedule buys time | Mortgage released in one go at key handover |
What a new build has going for it
A new build sells time and safety. Time: a 20/80 schedule lets you sign with 20% of the price and gather the rest, or sell a property elsewhere, over two or three years. Safety: the Sale Law obliges the developer to provide a bank guarantee or insurance on every shekel paid, the home is delivered with a mamad, lift, parking and current seismic standards, and the construction warranty covers defects for years. For a buyer abroad, a new build is also simpler: one counterpart, a standard contract, no agent, and a developer used to powers of attorney. There is no US-style inspection contingency; the warranty and the Sale Law play that role.
The flip side is indexation and delay. The construction cost index rose 3 to 5% a year between 2022 and 2025; applied to 80% of the price over two years, it adds 5 to 8% to the list price. And delivery often slips by six months to a year, a period during which you pay rent elsewhere or collect none. The guarantees, pitfalls and clauses to negotiate are in buying off-plan from a developer; the specific risks are covered in the buyers’ questions.
What a resale has going for it
A resale sells a price and availability. The price is negotiable, especially on a third-floor walk-up or in a 1975 building that needs work. The home can be rented or lived in within two months of the contract, which changes everything for an investor: three years of rent at ₪5,800 is more than ₪200,000. Older neighbourhoods are also the most central, where new builds hardly exist any more except as TAMA 38 or pinui-binui projects.
The flip side: the agent fee (2% + VAT, close to ₪50,000 on ₪2.1M), the works, no mamad in pre-1992 buildings, and heavier legal due diligence for the lawyer: rights registered at the Tabu or the ILA, extensions without a permit, vaad bayit (building committee) debts, easements. What the lawyer checks is in the real estate lawyer in Israel, and the procedure in how to buy property in Israel.
3-year example: ₪2.4M new versus ₪2.1M resale
| Item | New, ₪2,400,000 | Resale, ₪2,100,000 |
|---|---|---|
| Contract price | ₪2,400,000 | ₪2,100,000 |
| Mas rechisha (8%, non-resident) | ₪192,000 | ₪168,000 |
| Lawyer | ≈ ₪6,500 (capped) | ≈ ₪18,600 (0.75% + VAT) |
| Agent | 0 | ≈ ₪49,600 (2% + VAT) |
| Indexation of the balance (80% × ≈ 6%) | ≈ ₪115,000 | 0 |
| Works and maintenance over 3 years | ≈ 0 (warranty) | ≈ ₪70,000 |
| Vaad bayit over the holding period | ≈ ₪7,200 (12 months) | ≈ ₪9,000 (36 months) |
| Rent collected | − ₪78,000 (12 months) | − ₪208,800 (36 months) |
| Net cost over 3 years | ≈ ₪2,642,700 | ≈ ₪2,206,400 |
| Gap | ≈ ₪436,000 in favour of the resale, of which ₪300,000 is price | |
The gap beyond price comes from indexation and the two years without rent. It narrows if the developer caps indexation, if delivery is at 12 months rather than 24, or if resale value is counted: a new home with a mamad and parking generally resells at a 5 to 10% premium over the equivalent older one. For a buyer who will live in the home and needs no rent, the calculation changes again. The exact tax for your status is on the purchase tax calculator.
How to decide
- You are buying to rent out immediately, or you live abroad and want income: a well-located resale, with an agency that manages it.
- You are preparing aliyah in two or three years and do not have the full deposit: a new build on a 20/80 schedule, which lines up delivery with your move and leaves time to arrange the mortgage.
- You want a central neighbourhood in Tel Aviv, Jerusalem or Haifa: a resale, for lack of new builds, or an urban renewal project with an experienced lawyer.
- You want to minimise surprises from a distance: a new build, with a lawyer independent of the developer to review the contract.
Prices by city, new and resale combined, are in Israel real estate prices in 2026, and the full budget of each option in what buying really costs.
Frequently asked questions
Is purchase tax different on a new build?
No. Mas rechisha applies on the same schedule, on the VAT-inclusive contract price, new or resale. A resident buying their only home pays 0% up to ₪1,978,745, a non-resident 8%. The only practical difference: on a new build the tax is filed at signing, often two or three years before delivery.
What is the indexation of the balance on a new build?
Instalments not yet paid are linked to the madad tshumot habniya (construction cost index), published monthly by the Central Bureau of Statistics. On a 20/80 schedule with delivery in two years, a 3% annual rise in the index adds about 6% to the remaining 80%, or ₪115,000 on a ₪2.4M property. Some developers cap or waive indexation when inventory is high.
Is a resale apartment without a mamad a problem?
It is a comfort and safety drawback, and a 5 to 10% discount factor at resale. Buildings from before 1992 have no safe room; some have a communal shelter (miklat). One can sometimes be added through a TAMA 38 project, but that is neither quick nor guaranteed.
Can you negotiate the price of a new build?
Rarely on the list price, often on everything else: finishes, kitchen, parking, storage, waiver or cap on indexation, a 10/90 or 20/80 schedule, the developer covering legal fees. In 2025-2026, with high new-build inventory, these concessions are worth 3 to 8% of the price. On a resale, the room on price is 3 to 8% depending on the city.
