Real Estate Lawyer in Tel Aviv: Fees, Local Specifics, English Speakers
Tel Aviv is Israel’s most expensive market and the densest in complicated deals: off-plan towers, 1930s–60s buildings waiting for TAMA 38, condominiums never registered, Jaffa plots with unusual status. The lawyer does the same job as anywhere else, with twice as much to read. Here is what they check, what they charge, and how a buyer in New York, London or Toronto works with them without flying in.
The short answer
In Tel Aviv, a real estate lawyer charges 0.5 to 1% + 18% VAT like everywhere else, but on an average price of ₪4.59M (CBS, Q1 2026, +10.3% year on year): at 0.5%, about 22,950 ₪ before VAT, 27,081 ₪ with VAT, and most firms switch to a flat fee above ₪4M. What they check on top here: the rights attached to TAMA 38 and pinui-binui buildings, new tower contracts, old buildings whose condominium was never registered, Minhal and Jaffa plots, parking and storage registered separately, and the by-laws on short-term rentals. On ₪4.5M, purchase tax runs from 12,606 ₪ (oleh) to 360,000 ₪ (non-resident).

What the lawyer checks on top in Tel Aviv
The base is the same everywhere: land registry extract (nesach Tabu), liens, permits, debts, condominium, the seller’s tax status, described on the page the real estate lawyer’s role. In Tel Aviv, seven topics come up in almost every file.
- TAMA 38 and pinui-binui buildings. Hundreds of 1950s–70s buildings have signed, or are negotiating, a reinforcement-and-extension project (TAMA 38/1), a demolish-and-rebuild (TAMA 38/2) or a pinui-binui. The lawyer reads the agreement with the developer: who signed, where the permit stands, what guarantees, what floor area and parking you will get, and above all what the seller has already given away. Building rights (zchuyot bniya) may have been sold separately; a listing “with TAMA 38” does not tell you whether you benefit.
- New towers and developer contracts. Park Tzameret, Bavli, the station district, Florentin, Jaffa: new-build in Tel Aviv sells off-plan, with contracts of 80 to 120 pages. The lawyer checks the final permit, the Sale Law guarantee on each instalment, the indexation of the balance to the madad tshumot habniya (construction cost index), late penalties from 60 days, the technical specification (mifrat) and the price of parking and storage, rarely included. The 20/80 schedules of 2025–2026 expose 80% of the price to indexation during construction. The detail is on the page buying off-plan.
- Unregistered condominiums. Many old buildings in the centre and the White City were never constituted as a bayit meshutaf at the Tabu: the property is an undivided share of a plot, with a use agreement between owners. The lawyer checks that agreement, the rights to the roof, the yard and the parking, and whether the condominium can be registered. Banks do lend, but ask for more documents.
- Minhal land. In some areas (north of the city, parts of Ramat Aviv, 1950s–60s neighborhoods), the land belongs to the State and the owner holds a lease (hakhira) from the Israel Land Authority. The transfer goes through the Minhal, with longer timelines and sometimes consent fees.
- Jaffa. Plots in undivided ownership, land leased from religious institutions (church, waqf), protected buildings and rights of way in the Old City and Ajami: every Jaffa file calls for a longer reading of the title, and sometimes a specialist’s opinion.
- Parking and storage registered separately. In Tel Aviv a parking space is worth ₪250,000 to ₪500,000 and is often registered as a separate sub-plot or merely “attached” (hatzmada) to the apartment. The lawyer checks that what you pay for is actually registered, and transferable with the home.
- Short-term rentals. If your plan relies on Airbnb, the lawyer reads the condominium by-laws and the owners’ meeting decisions: more and more buildings prohibit it, and since 2024 the municipality applies higher arnona to apartments rented short-term.
Fees in Tel Aviv
| Property | Price | Fee | Note |
|---|---|---|---|
| 2-room second-hand, Florentin or Yad Eliyahu | ₪2.4M | ₪12,000–18,000 (0.5–0.75%) | Often a flat fee; condominium to check. |
| 3–4 rooms second-hand, Old North, with TAMA 38 agreement | ₪4.5M | ₪22,500–30,000 (0.5–0.65%) | Reading of the developer agreement on top. |
| 4 rooms off-plan, tower in Park Tzameret or Bavli | ₪6.5M | Flat ₪25,000–35,000 | + developer’s lawyer capped ≈ ₪5,500, who does not represent you. |
| House or penthouse, Neve Tzedek | ₪12M | Flat ₪40,000–50,000 (≈ 0.4%) | Decreasing, negotiable. |
| Power of attorney and remote purchase | — | + ₪1,500–4,000 | Template, consular coordination, translations. |
Tel Aviv firms move to flat fees sooner than firms elsewhere: above ₪4M, a 1% rate would give ₪40,000 for work comparable to a ₪2M property. Ask for the flat fee and its engagement letter (heskem sachar tircha); the selection criteria and the questions to ask are on the page how to choose your real estate lawyer, and the full budget (agency 2% + VAT, broker, appraisal) on every fee of a purchase.
Purchase tax on ₪4.5M: resident, non-resident, oleh
| Resident, only home (0% up to ₪1,978,745, 3.5%, then 5%) | 120,538 ₪ |
| Non-resident or additional home (8%) | 360,000 ₪ |
| New oleh, only home (0% then 0.5%) | 12,606 ₪ |
| Gap non-resident / resident | 239,462 ₪ |
| Gap non-resident / oleh | 347,394 ₪ |
A non-resident who moves to Israel within two years of the purchase can apply to be reclassified as “only home” and recover the gap. The lawyer chooses the declared status with you, files within 30 days, and payment is due within 60 days. Worked examples are on the page mas rechisha 2026; test your own price on the calculator.

Where the firms are, and how they work
Tel Aviv’s real estate firms cluster around Rothschild Boulevard, the Azrieli towers and Sarona, ten minutes from the Tel Aviv Tabu office. Many have one or more English-speaking lawyers, and almost all handle a large share of files for foreign buyers: Tel Aviv is, with Jerusalem and Netanya, one of the cities with the most non-resident owners. In practice the work is done by email and video call; you only come to the office to sign, if you come at all.
Three criteria matter more than the address: specialization (real estate every day, with recent tower and TAMA 38 files), independence (no link with the agency that showed you the property or with the developer), and experience with remote files.
Buying in Tel Aviv without flying in: the sequence
20-minute call, engagement letter signed by email. The firm pulls the nesach Tabu and requests the condominium or developer documents.
Due-diligence report: title, permits, TAMA 38, parking, debts. Video call to decide on the offer and the conditions.
Contract negotiation with the seller’s lawyer or mark-up of the developer’s contract. In parallel, bank pre-approval: a non-resident finances 50% in practice.
Power of attorney (yipui koach) signed at an Israeli consulate or before a notary and then apostilled; original sent to the firm.
The lawyer signs for you. Deposit of 10 to 20% in escrow, hearat azhara registered within 7 days, mas rechisha filed within 30 days.
Payments per the schedule, release of the seller’s lien, handover, registration at the Tabu or the Minhal.
The POA procedure is detailed on the page power of attorney and remote purchase. Financing is what most often blocks a foreign buyer in Tel Aviv: a 50% down payment on ₪4.5M means ₪2.25M to raise, plus ₪360,000 of tax and about ₪150,000 of costs.
Frequently asked questions
How much does a real estate lawyer cost in Tel Aviv?
The same rates as elsewhere, 0.5 to 1% + 18% VAT, but applied to high prices: on the average price of ₪4.59M, 0.5% is ₪22,950 before VAT, about ₪27,100 with VAT. Above ₪4M, most Tel Aviv firms offer a flat fee of ₪18,000 to ₪30,000 before VAT rather than a percentage, and go down to 0.4% on ₪8–10M properties. An off-plan tower or a TAMA 38 file is priced at the top of the range.
What is TAMA 38 and why does the lawyer spend time on it?
TAMA 38 is the national earthquake-reinforcement plan: a developer reinforces and extends an old building, adds a mamad (safe room), a lift and a balcony to each apartment, and pays for it by building extra apartments on the roof. If you buy in a building “with TAMA 38 signed”, the lawyer checks the project’s stage (owners’ signatures, permit, developer, guarantees), what the seller has already given away (building rights, parking) and what will come to you. Building rights are sometimes sold separately from the apartment.
What purchase tax does a non-resident pay on a ₪4.5M apartment in Tel Aviv?
8% up to ₪6,055,070, i.e. ₪360,000 on ₪4.5M. A resident buying their only home pays about ₪120,500, a new oleh about ₪12,600. A non-resident who moves to Israel within two years can apply to be reclassified as “only home” and recover the difference. The lawyer files the declaration within 30 days.
Can I rent short-term (Airbnb) in Tel Aviv?
The municipality has tightened the rules since 2024: higher arnona for apartments rented short-term, inspections, and condominium by-laws that increasingly prohibit it. A lawyer checks the bayit meshutaf by-laws and the owners’ meeting decisions before signing if your plan relies on tourist rentals; they cannot guarantee that municipal rules will stay stable.
Do Tel Aviv firms work with buyers who do not come?
It is the norm for the downtown firms (Rothschild, Azrieli, Sarona): power of attorney signed at an Israeli consulate in New York, London, Toronto or Sydney, or before a notary and then apostilled, video calls for the contract negotiation, viewings filmed by the agency. Count ₪1,500 to ₪4,000 extra for the POA and translations, and two to three weeks of consular lead time.
